This is an English translation of the Dutch general terms and conditions ("Algemene Voorwaarden") of Etheron Hosting. In the event of any discrepancy between this translation and the Dutch original, the Dutch text shall prevail.
Art. 1 – Definitions
- Etheron Hosting: Etheron Hosting, established at Ampèrestraat 11, 1817 DE Alkmaar, the Netherlands, registered in the Dutch Commercial Register under Chamber of Commerce number 75539519.
- Customer: the natural or legal person with whom Etheron Hosting has concluded an agreement or intends to conclude one.
- Consumer: a customer who is a natural person and is not acting in the exercise of a profession or business.
- Parties: Etheron Hosting and the customer jointly.
- Service: any hosting, domain, server or related service offered or supplied by Etheron Hosting.
- Personal data: all information about an identified or identifiable natural person, as referred to in the General Data Protection Regulation (GDPR).
Art. 2 – Applicability
- These general terms and conditions apply to all quotations, offers, work, orders, agreements and deliveries of services or products by or on behalf of Etheron Hosting.
- The parties may only deviate from these terms in writing.
- The applicability of any general terms and conditions of the customer or third parties is expressly rejected.
- By registering with Etheron Hosting, the customer guarantees to be 18 years of age or older, or to have the consent of a legal representative.
- If one or more provisions of these terms are null or voidable, the remaining provisions shall remain in full force.
Art. 3 – Offers and quotations
- Offers and quotations from Etheron Hosting are without obligation, unless expressly stated otherwise.
- An offer or quotation is valid for 30 days from its date, unless a different period is stated.
- Offers and quotations do not automatically apply to follow-up orders.
- Upon acceptance of a non-binding quotation, Etheron Hosting reserves the right to withdraw the quotation within 3 working days of receiving the acceptance.
Art. 4 – Acceptance
- An agreement is concluded once the customer accepts an offer or quotation and has met the payment conditions, or after Etheron Hosting has confirmed the order in writing or electronically.
- Verbal acceptance only binds Etheron Hosting after written or electronic confirmation by the customer.
- Etheron Hosting reserves the right to refuse any order or assignment without giving reasons.
Art. 5 – Prices
- All prices are in euros and include VAT, unless expressly stated otherwise.
- Etheron Hosting may change published prices at any time.
- Price increases resulting from rising purchase costs or statutory obligations will be passed on to the customer.
- The consumer is entitled to dissolve the agreement in the event of a price increase, unless the increase results from a statutory regulation.
- Etheron Hosting is entitled to index its rates annually on the basis of the consumer price index (CPI) of Statistics Netherlands (CBS).
- Price adjustments will be communicated to the customer at least 30 days before they take effect.
- If the parties have agreed on a target price, Etheron Hosting is entitled to deviate from it by up to 10%. In the event of a larger deviation, Etheron Hosting will inform the customer in good time.
Art. 6 – Payments and payment term
- Etheron Hosting may require an advance payment of up to 50% when entering into the agreement.
- The customer must pay before or upon delivery, unless agreed otherwise.
- Payment terms are strict deadlines. Exceeding them automatically results in default, without any reminder being required.
- Etheron Hosting accepts payment via the payment methods indicated on its website.
- Etheron Hosting reserves the right to make delivery dependent on immediate payment or the provision of security.
Art. 7 – Consequences of late payment
- In the event of late payment, the customer is automatically in default and Etheron Hosting is entitled to charge statutory (commercial) interest from the due date.
- All reasonable extrajudicial collection costs are at the expense of the customer, calculated in accordance with the Dutch Decree on Compensation for Extrajudicial Collection Costs.
- Etheron Hosting is entitled to suspend its services until the customer has fulfilled their payment obligations.
- In the event of bankruptcy, suspension of payment or seizure, all claims of Etheron Hosting are immediately due and payable.
Art. 8 – Right of withdrawal (consumers)
- A consumer may dissolve an online purchase within 14 calendar days of delivery, without giving reasons, provided that:
- the service has not yet been put into use;
- it does not concern a custom-made service or product;
- the consumer has not expressly waived the right of withdrawal.
- The right of withdrawal does not apply to domain names, SSL certificates and other digital products of which delivery has commenced immediately with the consumer's express consent.
- The right of withdrawal can be exercised by submitting a ticket via https://mijn.etheron.nl/submitticket.php.
- Etheron Hosting will refund the purchase price within 14 days of receiving the withdrawal notice, provided the product has been returned in time or the use has been ceased.
- If the service has already been (partially) used at the time of withdrawal, Etheron Hosting is entitled to charge a pro rata fee for the period already used and to deduct this amount from the refund. The deduction is calculated on the basis of the daily rate (monthly price divided by the number of days in the relevant month), multiplied by the number of days used. Example: for a service of €50 per month (30 days) and withdrawal after 10 days, €16.67 is deducted and the customer receives a refund of €33.33.
- If the customer initiates a chargeback or similar reversal via their payment method without prior contact with Etheron Hosting, the service will be suspended immediately and an administration fee of €25 will be charged.
Art. 9 – Right of retention and retention of title
- Etheron Hosting retains ownership of all delivered products until the customer has fully met all payment obligations.
- Etheron Hosting may invoke its right of retention and hold products or access to services of the customer until all outstanding claims have been settled.
- Etheron Hosting is not liable for any damage suffered by the customer as a result of the exercise of the right of retention or the retention of title.
Art. 10 – Delivery and delivery time
- Digital services are delivered after receipt of payment, unless agreed otherwise.
- Stated delivery times are indicative and do not entitle the customer to dissolution or compensation if exceeded, unless agreed otherwise in writing.
- Exceeding the delivery time entitles the customer to dissolution only if Etheron Hosting fails to deliver within 14 days after written notice of default.
Art. 11 – Agreement and performance
- Etheron Hosting is entitled to have the agreement performed (in part) by third parties.
- Etheron Hosting reserves the right to modify, merge or terminate services. In case of termination of an ongoing service, the customer will be informed at least 30 days in advance and will receive a proportional refund for the unused period.
- Etheron Hosting may refuse orders or assignments without giving reasons.
Art. 12 – Customer's information obligations
- The customer shall provide all information, data and documents necessary for the proper performance of the agreement in good time.
- The customer warrants the accuracy, completeness and reliability of the information they provide.
- Additional costs and work resulting from the customer's failure to provide information, or providing it late or incorrectly, will be at the customer's expense.
Art. 13 – Intellectual property
- Etheron Hosting retains all intellectual property rights in designs, software, documentation and other materials developed by it, unless agreed otherwise in writing.
- The customer obtains only a non-exclusive, non-transferable right of use for the duration of the agreement.
- The customer is not permitted to copy, make available to third parties or otherwise exploit Etheron Hosting's intellectual property without prior written consent.
Art. 14 – Personal data and GDPR
- Etheron Hosting processes customers' personal data in accordance with the General Data Protection Regulation (GDPR) and the Dutch GDPR Implementation Act.
- Etheron Hosting acts as the data controller for personal data processed in the context of its services.
- The customer has the right to access, rectification, erasure, restriction of processing, data portability and objection in accordance with the GDPR. Requests can be submitted via https://mijn.etheron.nl/submitticket.php.
- Etheron Hosting takes appropriate technical and organisational measures to protect personal data against unauthorised access, loss or destruction.
- If Etheron Hosting acts as a processor on behalf of the customer, a data processing agreement will be concluded in accordance with Article 28 GDPR.
- In the event of a data breach that is likely to result in a risk to the rights and freedoms of data subjects, Etheron Hosting will report this to the Dutch Data Protection Authority within 72 hours.

Art. 15 – Complaints
- The customer shall examine a delivered service or product as soon as possible after delivery.
- Complaints must be submitted as soon as possible, and no later than 30 days after discovery, by ticket via https://mijn.etheron.nl/submitticket.php, with as detailed a description as possible.
- For consumers, a complaint period of 2 months from the discovery of the defect applies.
- A complaint does not suspend the customer's payment obligation.
- If a complaint is well-founded, Etheron Hosting will, at its discretion, repair, replace or credit the shortcoming.
Art. 16 – Liability of Etheron Hosting
- Etheron Hosting is only liable for direct damage that is the direct consequence of an attributable shortcoming.
- Etheron Hosting is never liable for indirect damage, consequential damage, lost profits, missed savings or damage due to business interruption.
- Etheron Hosting's liability is at all times limited to the amount paid out by its professional liability insurance, or – in the absence thereof – to the invoice amount paid by the customer in the 3 months preceding the event causing the damage.
- Etheron Hosting is not liable for loss of data. The customer is responsible for making back-ups.
- Any claim for liability lapses 12 months after the event giving rise to the damage, without prejudice to Article 6:89 of the Dutch Civil Code.
Art. 17 – Indemnification
The customer indemnifies Etheron Hosting against all third-party claims relating to content supplied by the customer, infringement of intellectual property rights or breach of laws and regulations by the customer.
Art. 18 – Force majeure
- Etheron Hosting cannot be held to perform in the event of force majeure within the meaning of Article 6:75 of the Dutch Civil Code.
- Force majeure also includes: DDoS and cyber attacks, disruptions at data centres or internet providers, cable breaks, power outages, natural disasters, pandemics, labour disputes and government measures.
- Obligations are suspended for as long as the force majeure situation continues.
- If a force majeure situation lasts longer than 60 days, both parties are entitled to dissolve the agreement in writing without any right to compensation.
Art. 19 – Right of dissolution
- The customer is entitled to dissolve the agreement if Etheron Hosting attributably fails to perform and, after notice of default, fails to perform within a reasonable period.
- Etheron Hosting is entitled to dissolve the agreement with immediate effect if the customer fails to fulfil their obligations, is in suspension of payment, becomes bankrupt or makes improper use of the services.
Art. 20 – Amendment of these terms
- Etheron Hosting is entitled to amend these terms.
- Amendments will be communicated to the customer at least 30 days before they take effect, by e-mail or via the website.
- The consumer has the right to terminate the agreement in the event of a material change to the terms.
- Continued use of the services after the effective date of the amended terms constitutes acceptance.
Art. 21 – Applicable law and competent court
- All agreements between Etheron Hosting and the customer are governed exclusively by Dutch law.
- Disputes will be submitted exclusively to the competent court of the District Court of North Holland, location Alkmaar, unless mandatory rules of law designate another court.
- The parties shall only have recourse to the courts after they have made every effort to resolve the dispute by mutual consultation.
Art. 22 – Conditions per service
- Etheron Hosting is not liable for data loss. The customer is responsible for making back-ups.
- Etheron Hosting is entitled to suspend or terminate services with immediate effect if the customer engages in illegal activities or acts contrary to Dutch law or Etheron Hosting's terms.
- Etheron Hosting is entitled to switch off a server in case of misuse, danger to the infrastructure or by order of a competent authority.
- After a service has expired, files will be deleted without further warning after 7 days, unless the customer has timely requested a renewal.
- The customer shall use the purchased service(s) only for the purpose for which they are intended.
- Etheron Hosting is entitled to limit services or charge additional fees in case of demonstrably excessive use, including excessive bandwidth usage.
- Domain names and SSL certificates are not eligible for a refund after registration or issuance.
- For websites built by Etheron Hosting, a maximum refund of 50% of the amount paid applies, at Etheron Hosting's discretion.
Art. 23 – Fair use
- Services with unlimited storage and/or unlimited data traffic are subject to a fair use policy.
- Specific fair use limits per service:
- Web hosting: If a package exceeds 1 TB of data traffic per calendar month, Etheron Hosting will contact the customer to discuss the usage.
